Should you feel that a high court decision is unconstitutional, you have the right to take the case to the Constitutional Court of South Africa. The Constitutional Court has as aim to defend the constitution of this country. Our Constitution states that every person in this country has the right to equality, freedom, and human dignity also pertaining treatment in public and private health care systems of this country. Since the Government should protect the lives of its citizens it also means that patients have the right to receive urgent medical treatment.
This also means that should you for instance, be in an accident and in need of urgent medical care, that a private or public facility may not turn you away. You have the right to quality urgent medical care up to a level where your condition is stabilized at the nearest hospital. There have been many horror stories in the media about patients being turned away because a facility was full or because the patient did not have a medical aid. Some of the patients died while others have been permanently disabled or left in a poor health condition. As the medical profession is based on the principle of saving lives, no hospital has the right to turn a patient in need of urgent medical care away.
