Procedures to follow for a complaint

If you feel that you have grounds for a medical lawsuit and have followed the procedures of lodging a complaint without success, be sure to contact us to help file a medical lawsuit.

The formal procedures to follow if you want to lodge a complaint at the Health Professions Council of South Africa (HPCSA) if you feel that a medical professional has treated you in an unprofessional manner are as follows:

  • Lodge the complaint in writing with the Registrar of HPCSA.
  • Make sure that the complaint is signed by you in person.
  • Supply detailed information as requested by the Council.
  • The practitioner will need to provide an explanation in writing with supportive documents.
  • The committee of the Preliminary Inquiry will assess the case and make a decision as to whether an inquiry will be required and whether the case can be finalised.
  • If a further inquiry is deemed to be necessary, further investigations will take place and the practitioner in question will receive a charge sheet.

Medical Lawsuit

Evidence as in any court case will be needed to support a medical lawsuit. As such gather as much evidence as you can. Also write down everything you remember from the first visit right through to where you are now. Remember that dates count and be sure to write down the dates of your appointments, procedures followed, and any conversations you had with the professional team or practitioner. Make copies of bills, statements, prescriptions where possible, and bring them along to your first visit. For loss of income bring evidence along plus any costs already incurred because of the suggested malpractice. If you have witnesses write their details down.

Your next step is to make an appointment with us to help assess how strong your case is and what the next step should be. We acknowledge the client’s right to keeping the procedures discreet. Contact us today if you want to file a medical lawsuit and follow the correct procedure from the start to maximize your chances of winning the case.
